DMCA Policy
How to report copyright infringement and file counter-notices under the DMCA.
Overview
M Studio Pro respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy outlines how copyright holders can report content they believe infringes their rights on our platform.
If you believe that content available on or through M Studio Pro infringes your copyright, you may submit a DMCA takedown notice. If you believe your content was wrongly removed, you may submit a counter-notice.
Filing a DMCA Notice
To file a DMCA takedown notice, you must be the copyright owner or authorized to act on the owner's behalf. Send your written notice to our designated DMCA agent (see below).
Before filing: Please consider whether the use qualifies as fair use under 17 U.S.C. § 107. DMCA notices should not be used for content that is authorized under fair use or other exceptions.
Notice Requirements
A valid DMCA takedown notice must include the following:

Identification of the copyrighted work — A description of the original work that you claim has been infringed. If multiple works are involved, provide a representative list.

Identification of the infringing material — The URL or specific location on M Studio Pro where the infringing content can be found. Be specific enough for us to locate the material.

Your contact information — Your full name, mailing address, telephone number, and email address.

Statement of good faith belief — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Statement of accuracy — A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Physical or electronic signature — The signature of the copyright owner or a person authorized to act on their behalf.

Filing a Counter-Notice
If your content was removed from M Studio Pro due to a DMCA takedown notice and you believe the removal was in error or misidentification, you may file a counter-notice.
Upon receiving a valid counter-notice, we may restore the removed content after 10–14 business days, unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringer.
Counter-Notice Requirements
A valid DMCA counter-notice must include:

Identification of removed material — The specific content that was removed and the location where it appeared before removal.

Statement of good faith belief — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the US, any judicial district in which M Studio Pro may be found), and that you will accept service of process from the person who filed the original notice.

Repeat Infringers
In accordance with the DMCA, M Studio Pro maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also limit access to the platform and remove infringing material at our discretion.
Good Faith
Important: Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled through mistake or misidentification, may be subject to liability.
Do not file a DMCA notice or counter-notice unless you have a good faith belief in your claim. Consult with legal counsel if you are unsure.
Response Time
We strive to process DMCA notices and counter-notices promptly:
- Acknowledgment: Within 2 business days of receipt
- Review and action: Within 5 business days of receipt
- Restoration (counter-notices): After 10–14 business days if no legal action is filed
Complex cases may require additional time. We will keep you informed of the status of your notice.
Marketplace User Content
M Studio Pro hosts a digital marketplace where independent sellers list their products. We respond to DMCA notices for marketplace content as follows:
- We review the notice and, if valid, remove or disable access to the allegedly infringing material
- We notify the seller whose content was removed, providing them with the original notice (minus your personal contact information if requested)
- The seller may file a counter-notice if they believe the removal was in error
- If the seller files a valid counter-notice and no legal action is taken within 10–14 business days, the content may be restored
M Studio Pro reserves the right to remove content and terminate seller accounts at its discretion.
